Getting Divorced in Kansas

The district court will grant a decree of divorce for any of the following grounds:

  • Incompatibility;
  • Failure to perform a material marital duty or obligation; or
  • Incompatibility by reason of mental illness or mental incapacity of one or both spouses. (Certain restrictions apply. See Kansas State Code for further information.)

Residency Requirements

The petitioner or respondent in an action for divorce must have been an actual resident of Kansas for 60 days immediately preceding the filing of the petition. This includes military personnel stationed at a United States post or military reservation within the state of Kansas.

Waiting Period

An action for divorce will be heard 60 days after the filing of the petition.
