Getting Divorced in New Mexico
According to New Mexico Code, a district court may decree a dissolution of marriage on any of the following grounds:
- Incompatibility;
- Cruel and inhuman treatment;
- Adultery; or
- Abandonment.
Residency Requirements
At the time of filing the petition either party must have resided in New Mexico for at least 6 months immediately preceding the date of the filing.
Waiting Period
No final judgment will be granted until 10 days after filing, except where the parties have permanently separated for a period of at least 6 months preceding the filing of the complaint.
