Getting Divorced in Nebraska

The court will grant a dissolution of marriage when it is proven that the marriage is irretrievably broken. This is sometimes referred to as a no-fault divorce. There are no requirements to be proven beyond the fact that the marriage is irretrievably broken, and the court will make no determination of fault.

Residency Requirements

One of the parties obtaining a divorce must be living in Nebraska within 12 months prior to the commencement of the proceeding. This also applies to military personnel stationed in Nebraska.

Waiting Period

A decree may be entered 60 days after notice has been given to a spouse. Also, according to the law in Nebraska, you must wait 6 months before being allowed to marry again.
